Member Action Request coming Monday on FAA drone rule

VAI members: Please prepare to resubmit VAI’s comments on electronic conspicuity devices by Wednesday, Feb. 11.

VAI members, we need your continued support to shape the FAA’s Beyond Visual Line of Sight (BVLOS) drone rule.

The FAA has reopened the public comment period on its proposed Part 108 BVLOS rule. The reopened window asks a series of pointed questions focused exclusively on electronic conspicuity (EC) devices. Our responses will guide final rulemaking on right-of-way and detect-and-avoid concepts.

On Monday, Feb. 9, we’ll share instructions on how to resubmit VAI’s comments under your name and company.

What You Need to Know

• Deadline: Wednesday, Feb. 11, 2026
• Docket: FAA–2025–1908 via Regulations.gov
• VAI will send a link for you to submit VAI’s comments under your or your company’s name. It will only require a few clicks.

What the FAA Is Asking Industry to Do

Respond to seven posed questions and sub-questions related to EC devices, including:

• Availability of EC devices capable of meeting proposed Part 108 requirements
• Whether these devices have been approved and for what purposes
• Whether it is appropriate to use existing rulemaking or standards for EC device performance requirements
• Appropriateness of failure indicator requirements for EC devices
• Any other technologies the FAA should consider that manned operators could use to be electronically detectable.

What to Do Now

Watch for VAI’s announcement in VAI Daily on Monday, Feb. 9. Set aside 5 minutes to submit VAI’s comments the same day. Submit no later than Feb. 11.
